Contest Rules, Regulations, Terms and Conditions
NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE OF LEGAL AGE OF MAJORITY IN THEIR JURISDICTION OF RESIDENCE (AND AT LEAST 18 YEARS OF AGE) Employees (and their immediate families [parent, child, spouse or sibling and their respective spouses, regardless of where they reside] and those living in their same households, whether or not related) of PriceGrabber.com Inc. ("Sponsor") and its respective parents, affiliates, subsidiaries, and participating advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws.
TO ENTER: The Promotion begins at 12:01 a.m. Eastern Daylight Time on Monday, October 18, 2010 and ends at 11:59 p.m. Eastern Daylight Time on Tuesday, November 30, 2010 ("Promotion Period"). During the Promotion Period, visit www.instyle.com (the "Site") and complete the form in accordance with the on-screen instructions, including subscribing to the PriceGrabber email newsletter, and you will automatically receive one entry into the Sweepstakes. Limit one entry per person. Entry through the Site is the only means of entering the Promotion. Entries using macro, script or other forms of automatic entry and entries which subvert the entry process will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. No entries may be submitted on behalf of another person.
PRIZES AND APPROXIMATE RETAIL VALUES: Five (5) winners will receive Linea Pelle suede hobo handbags in camel color. Approximate retail value of each first prize: $475.00. Sponsor will pay any shipping and handling costs.
PRIZE CONDITIONS: Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or any portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local income taxes. Winners are responsible for any expenses associated with prize acceptance and use not expressly specified herein as being provided. All prize details are at Sponsor's sole discretion.
DRAWING: Prize winners will be selected in a random drawing conducted by Sponsor and held on or about December 9, 2010 from all eligible entries received. Odds of winning depend on the number of eligible entries received.
WINNER NOTIFICATION/REQUIREMENTS: Winners will be notified by e-mail at Sponsor's discretion. If prize notification is returned as undeliverable, or if a winner does not respond to the prize notification within ten (10) days of receipt, or if a winner is not in compliance with these rules, prize may be forfeited and, at Sponsor's discretion, alternate winners may be selected. Grand Prize winner will be required to execute and return an affidavit of eligibility, a liability release, a completed IRS W-9 form, and, where lawful, a publicity release within ten (10) days of date of issuance. If such documents are not returned within the specified time period Grand Prize may be forfeited and, at Sponsor's discretion, an alternate Grand Prize winner may be selected.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or garbled stay data, emails, online or mailed entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of completed stays or entries, the announcement of the prizes or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Promotion or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion at any time and for any reason arising from circumstances beyond its reasonable control, including, but not limited to, should any portion of the Promotion be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. If there is a dispute as to the identity of an entrant, the prize will be awarded to the authorized account holder of the email address and s/he must comply with these Official Rules. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an Internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
LIMITATIONS OF LIABILITY: Neither the Sponsor nor any of its respective parents, affiliates, subsidiaries or participating advertising and promotion agencies or any of their respective officers, directors, employees, representatives and agents (collectively, "Released Parties") will have any liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including without limitation any travel or activity related thereto or liability for any taxes due thereon) or participation in this Promotion.
GRANT OF PUBLICITY: Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes relating to this Promotion without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
GOVERNING LAW/JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the state of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. Venue for all suits will be in federal or state courts located in Los Angeles County, in the state of California.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
